1. Overview

This BaseSpace Informatics Suite Privacy Policy ("Privacy Policy") explains how we may use information collected through use of the BaseSpace Informatics Suite of products and services. Your access to or use of the product or service represents your agreement to this Privacy Policy, the Illumina Corporate Privacy Policy, and for the information we collect or may use (described in more detail in the Information We May Collect or Use section of this Privacy Policy) to be used by Illumina in accordance with this Privacy Policy and the Illumina Corporate Privacy Policy.

In this Privacy Policy the term "you" and "your" refers to the user of the product or service, whether an individual or organization (e.g., a corporate entity, government organization), and the terms "Illumina","we","us", and "our" refers to Illumina, Inc. and its affiliates and subsidiaries, globally.

2. Applicability Across the BaseSpace Informatics Suite

This Privacy Policy applies to all Software as a Service (SaaS) products and services within the BaseSpace Informatics Suite (collectively referred to as the "Services" and each individually referred to as a "Service"), including without limitation, BaseSpace Sequence Hub, BaseSpace Correlation Engine, BaseSpace Variant Interpreter, BaseSpace Cohort Analyzer, BaseSpace Biomarker Repository, and BaseSpace (Clarity) LIMS. Unless expressly stated otherwise in this Privacy Policy, this Privacy Policy replaces and supersedes all previous privacy policies that applied to those Services.

3. Other Illumina Websites and Products May Have Separate Privacy Policies

Please note that other websites of Illumina or its affiliates and subsidiaries and other Illumina products and web-based services may have separate privacy policies and terms of use that apply to their use.

4. Opt-In and Opt-Outs for Collection or Use of Certain Information

Some Services may have Opt-In or Opt-Out options. For the Services that have an Opt-In or Opt-Out option this Section explains how they work.

Section 6 of this Privacy Policy, How we May Use the Information, explains how we may use the information you allow us to collect or use through an Opt-In or Opt-Out.

Note: Your selection of Opt-In or Opt-Out only applies to our collection or use of the described information after the point in time you make your selection. For example, if you previously Opted-In to our collection or use of certain information and later change your mind, we will stop collecting or using it going forward, but will retain any of the information previously collected and may continue to use it.

5. Information We May Collect or Use

We may collect information about the users of the Services ("User Information") as well as information about the data submitted to, collected via, processed or stored in, transmitted using, or created using the Services (collectively referred to as the "Data").

The information described in this Section is in addition to any information you have allowed us to collect or use through an Opt-In or Opt-Out.

Section 6, How We May Use the Information, explains how we may use the information that is described in this Section 5.

6. How We May Use the Information

We may use information for a variety of purposes, including without limitation, to improve the Services, improve our other products and services, develop new products and services, conduct transactions with you, and verify compliance with the terms of any agreement between you and us. We may also use the information in any way you expressly allow us.

Additional uses of information we collect about users are described in the Illumina Corporate Privacy Policy.

7. Sharing and Transferring Ownership of Data

The Services may offer features that allow you to provide User Information, which could include the user’s personal information, other information, and the Data to others such as through use of a sharing, transfer of ownership, or other similar feature. When using these features, people and organizations who have been provided that information may download, use, store, and further use that information even if you have changed that information, changed your settings, or removed that information later on. If you have given us access to your Data for technical support purposes we will not use your Data except as is necessary to provide technical support. However, if you have shared your Data, transferred ownership of your Data, or used another similar feature to provide your Data to us, we will have the same rights to that Data as any other recipient you could have shared or transferred ownership to.

8. Changes to Privacy Policy

We reserve the right to change this Privacy Policy at any time. When we make changes, we will post the changed Privacy Policy and it will become effective thirty days thereafter ("Effective Date"). The changed Privacy Policy supersedes and replaces the prior version. Your continued access to or use of one or more of the Services represents your acceptance of such changed Privacy Policy. For the avoidance of doubt and unless expressly stated otherwise in this Privacy Policy, the changed Privacy Policy applies to all uses of the Services, including all User Information and information about the Data, inclusive of aggregation of Data, both before and after the Effective Date.

10. Genomic or Other Sensitive Data Submitted to or Created Using the Service

The Services may allow you to submit or create genomic data or other potentially sensitive information about an individual person ("Data Subject"). Please understand that, unless expressly stated otherwise in the Illumina provided description for the specific Service you are using, the Services may be provided outside of the country where you are located or outside of the country where the Data Subject is from (e.g., you may be located in Canada, but using a Service that is operated in a data center in the United States). Please refer to the Illumina provided description for the specific Service to determine the geographic region where the information may be sent or created.

Please understand that you are responsible for ensuring you comply with applicable law when you submit such information to the Services or use the Services to create such information. This includes a requirement that you obtain any informed consents from such Data Subjects when required by applicable law and authorizations from government or regulatory bodies when required by applicable law.
